Pre-Budget Report on a reduced rate of corporation tax on income from patents

The Chancellor, Alistair Darling, has today announced in his Pre-Budget Report a reduced rate of corporation tax for income from patents in the UK. The reduced rate will be 10% compared to the main UK rate of 28%.


According to the pre-budget report "the Government has looked at the case for a reduced rate of corporation tax applied to income from patents (aso-called “Patent Box”). The Government announces that it will introduce a Patent Box applying to income from April 2013 to strengthen the incentives to invest in innovative industries and ensure the UK remains an attractive location for innovation. The Government will consult with business in time for the Finance Bill 2011 on the detailed design of the Patent Box, which will apply to patents granted after the legislation is passed." 

This is good news for British businesses who are considering patenting and exploiting the results of their research and development. Most patents filed today will not yet be granted by April 2013 so it is not too soon to be considering the effect of this potential legislation.
