After reviewing the portfolio of our client, who was using multiple service providers, we became aware that a large number of cases were going to contested hearings and it was taking many years to obtain granted patents. After further analysis, we proposed an alternative IP strategy to reduce the complexity and length of patent prosecution.
The client was so appreciative of our advice that the number of new instructions received from the client the following year increased by over 400%. The strategy included being highly proactive in the initial prosecution stages when dealing with the European Patent Office. In practice this has not only reduced the number of hearings, and reduced the time taken to obtain granted patents, but it has also significantly reduced the clients’ spend in Europe due to the enhanced efficiencies introduced.
By looking at the bigger commercial picture and really understanding what the client wanted to achieve, we were able to propose the right strategy to meet the client’s needs.
