Own-label drinks company sued by competitor for trade mark infringement

Our client, an own-label drinks company, sought advice from a number of IP firms and commercial lawyers when it was sued for trade mark infringement by a major player in the market. All advised that the trade mark owner had a cast iron case and that our client should submit immediately and pay the trade mark owner’s costs. Our trade mark attorneys and IP lawyers thought differently and undertook a joint analysis. We said that not only was the case not cast iron, but our client had claims for passing-off, trade mark invalidity and unjustified threats. 


We recommended that our client file a defence and an aggressively worded counter-claim. We were confident that once the trade mark owner saw our client’s case and the measure of its resolve, a settlement in favour of our client would result. Six months on, we negotiated a substantial settlement payment to our client as well as recovery of all of our client’s legal costs. 

Because we’re not afraid to think differently to our competitors we were able to turn a threat into a revenue-generating opportunity for our client.
